I. Scope of Application

These General Terms and Conditions govern the intermediary services provided by **Elysium by Valeria GmbH** (hereinafter referred to as the “Agency”) as well as, additionally, the general terms and conditions of the respective independently operating escort models (hereinafter referred to as the “Model”) in relation to the respective customer (hereinafter referred to as the “Customer”).

Any deviating terms and conditions of the Customer shall not apply unless the Agency has expressly agreed to their validity in writing. Mandatory statutory provisions remain unaffected.

II. Role of the Agency / Contractual Relationship

The Agency arranges contacts between Customers and independently operating escort models as part of a companionship service. Any contract regarding the actual companionship is concluded exclusively between the Customer and the respective Model. The Agency itself is not a party to the companionship agreement and does not owe the performance or success of any meeting.

The Agency provides discreet coordination, preliminary arrangements, and organizational support for the Customer’s request.

III. Agency Services

All offers made by the Agency are non-binding. The Agency endeavors to recommend suitable Models in accordance with the Customer’s request. The Customer has no entitlement to the placement of a specific Model or to the conclusion of a meeting.

Each inquiry is reviewed individually. The Agency reserves the right to decline inquiries without stating any reasons.

IV. Selection & Independence of the Models

The escort models represented by Elysium act independently and make their own decisions regarding:

* whether to accept an inquiry;
* which services they wish to offer; and
* under which circumstances a companionship arrangement takes place.

Not every request is suitable for every Model. There is no entitlement to acceptance of a booking request. Information regarding possible experiences, preferences, or areas of focus is provided solely for guidance and does not constitute a contractual promise of performance.

V. Presentation of the Models

The texts, images, and information published on the website are based on details provided by the respective Models. The Agency assumes no responsibility for the factual accuracy or subjective perception of such information. Differences in chemistry, interpersonal dynamics, or personal impressions shall not constitute a defect.

VI. Booking & Formation of Contract

A booking begins with a non-binding inquiry from the Customer specifying:

• the desired date and time;
• the location; and
• the general framework of the requested companionship.

A contract between the Customer and the Model is only concluded when:

• the Model accepts the inquiry; and
• the Agency confirms the acceptance to the Customer.

Only upon such confirmation shall the booking become binding.

VII. Fees, Payments & Payment Processing

The fees are determined independently by the respective self-employed escort Models and are stated in each Model’s profile. The agreed fee exclusively covers the Model’s time and companionship. Payment is made directly between the Customer and the Model. The Agency does not charge a separate brokerage fee.

By submitting a booking request, the Customer expressly confirms that they are both willing and financially able to pay the agreed fee as well as any applicable travel expenses or additional costs.

Payment Methods & Customer Status

For payment purposes, a distinction is made between new customers and returning customers.

A Customer shall be considered a returning customer from the third completed booking onwards. Returning customers may settle the agreed fee either in cash or by bank transfer.

The same payment options apply to new customers, provided the meeting takes place at the Model’s home base or within a radius of up to 100 km.

Deposit for Long-Distance Bookings

For bookings outside the Model’s home base and beyond a radius of 100 km, new customers are required to pay a deposit amounting to 35% of the agreed fee. The remaining balance must be paid in cash at the beginning of the meeting.

Where payment is made in cash, the agreed fee must be discreetly handed over within the first 15 minutes of the meeting to ensure the smooth progression of the date.

Special Booking Arrangements

For bookings involving couples, the independently operating escort Models generally charge a surcharge of 50% of the regular fee.

Final confirmation and any individual conditions will be transparently agreed upon during the booking process.

Travel Expenses & Additional Costs

Travel expenses are not included in the agreed fee unless expressly agreed otherwise. Such expenses are charged separately and are specified in the respective Model profile.

For longer-distance destinations, travel costs are calculated individually as part of the booking inquiry. No further expenses are generally charged.

If the Model returns to their home location after 2:00 a.m., a hotel surcharge of €120 will apply.

Payments in Foreign Currencies

Upon request, payments may also be made in foreign currencies (e.g., US Dollars, British Pounds, or Swiss Francs).

Due to exchange rate fluctuations and additional processing costs, payments made in foreign currencies are subject to an additional service fee of 8%.

VIII. Travel Companion Services & Additional Costs

When booking the “Travel Companion” service, the Customer shall bear all travel-related and ancillary expenses incurred by the Model, including but not limited to transportation, accommodation, and meals.

Unless expressly agreed otherwise, travel expenses must be paid in advance.

Further details regarding travel cost calculations, flat-rate surcharges, and any additional expenses are governed by Section VII as well as the individual booking agreement.

IX. Cancellation & No-Show

The Customer may cancel a confirmed booking at any time before the scheduled meeting begins.

No cancellation fees will be charged. However, the Customer is obliged to inform the Agency of any cancellation immediately and as early as reasonably possible.

If the Model has already incurred verifiable travel or transportation expenses at the time of cancellation, such expenses shall be reimbursed by the Customer.

No additional cancellation charges, flat-rate compensation, or contractual penalties shall apply.

X. Termination of a Meeting

In the event of inappropriate conduct, disregard of agreed arrangements or personal boundaries, or any other circumstance that makes the continuation of the meeting unreasonable for the Model, the Model shall be entitled to terminate the meeting immediately and without notice.

In such cases, the Customer shall not be entitled to a refund of any payments already made.

If a meeting is terminated after it has commenced for reasons attributable to the Customer, including but not limited to refusal to pay, inappropriate conduct, or significant deviations from the agreed arrangements, the full agreed fee shall remain payable.

XI. Customer Obligations

The Customer undertakes in particular to:

• provide truthful information when submitting an inquiry;
• respect all agreed arrangements and the Model’s personal boundaries;
• behave respectfully and discreetly at all times; and
• refrain from requesting any illegal or previously unagreed activities.

XII. Confidentiality & Data Protection

The Agency treats all inquiries, personal data, and communications with the utmost confidentiality.

Personal data shall be processed exclusively in accordance with applicable data protection laws.

XIII. Liability

The Agency shall only be liable for damages resulting from intentional misconduct or gross negligence in connection with its intermediary services.

The Agency accepts no liability for any acts, conduct, services, omissions, or performance of the independently operating escort Models.

To the extent permitted by law, liability for indirect damages, consequential damages, or loss of profits is excluded.

Events of force majeure that wholly or partially prevent the arrangement or execution of a meeting shall not give rise to any claims for damages against the Agency.

XIV. Jurisdiction & Final Provisions

To the extent legally permissible, the place of jurisdiction shall be **Cologne, Germany**.

Should any provision of these General Terms and Conditions be or become invalid, the validity of the remaining provisions shall remain unaffected.

These General Terms and Conditions shall be governed exclusively by the laws of the Federal Republic of Germany.
